The Bordeaux application had been supported by Bordeaux Métropole since a vote in October 2020. For it to take effect (as in Paris, Lille, Lyon or Montpellier) and apply to all future leases, all that was missing was the prefectural decree defining median rents. It was released on Tuesday, June 22.
The measure will apply as follows: owners will not be allowed to offer their property at a price more than 20% higher than the median reference rent.
A little reminder in statistics: median means that half of the properties of the same type are rented for less. And the other half more expensive. This strategic figure was determined by the Bordeaux Aquitaine Urban Planning Agency (A’urba).

“For an ‘average’ property, this figure is 12.70 euros per square meter”, explains Nathanaël Fournier, scientific director of the A’urba rent observatory. As this average property does not exist, the rent control will take into account a multiplicity of factors.
To begin with, the city was divided into four zones reflecting market tensions and their disparities.
Then, the calculation brings into play several parameters: the period of construction, the number of rooms. But also the type of rental: empty or furnished. And the type of property: apartment or house – a national first in a city center, which Bordeaux owes to the stalls, its small urban houses.
Many unknowns, for an equation that tenants and owners will fortunately not have to solve themselves. “From July 5, a simulator will be put online, all you have to do is fill in the fields so that the median rent and the maximum rent are displayed”, announces Camille Moreau, from the housing department of Bordeaux Métropole. This online tool will be available for consultation at simulator-loyer.bordeaux-metropole.fr
Knowing the maximum authorized, will not all owners be tempted to align themselves with it, diverting the tool from its use? Camille Moreau wants to be reassuring: “Bordeaux being listed in a ‘tense zone’, the rent reference index (IRL) sets a limit to annual increases, even in the event of a change of occupant. »
Pierre Hurmic, he wants to reassure the owners. “With this simulator, those who practice compliant rents will be pleasantly surprised to find that they have nothing to change. On the other hand, for those who take advantage of the market tension to reap additional profits at the expense of tenants, the device is a deterrent….”

Indeed, amicable conciliation is recommended in the event of a dispute, but the regulations provide for penalties. If the case is brought before the judge, the owner exposes himself to having to reimburse the overpayment to the tenant. The prefecture can also impose fines of 5,000 to 15,000 euros.
Remain those who will have signed their lease before July 15 and will discover that they pay “too much”. “For them, the device does nothing. But perhaps they can negotiate with their landlord, knowing that if the former leave the accommodation, the latter will no longer be able to rent it at the same price, ”suggests Stéphane Pfeiffer, deputy mayor of Bordeaux in charge of housing.
Note that there is also a “reduced rent”, 20% below the reference rent. The owners concerned will have the right to make an increase during a change of lease, but without exceeding this “minus” threshold.
